01Purpose

Kapoland makes hand-painted paintings from the photographs supplied by the customer, in the styles, sizes, finishes and options described on the website. Each painting is a unique piece, made to order.

02Order

The customer composes the painting in the configurator, uploads one or more photographs, enters their details, accepts these terms and pays the price shown. The order is firm on receipt of payment; a confirmation is sent by email.

The customer warrants that they hold the rights to the photographs they send and the consent of the people in them.

03Prices

Prices are shown in euros, including all taxes, excluding delivery costs, which are shown before the order is confirmed. VAT scheme: being confirmed.

The price of a painting depends on the style, size, number of subjects, finish and options chosen. The amount charged is the one recalculated by our servers from these choices, shown before payment.

04Payment

Payment is made online, on a secure payment page, by Bank card, Apple Pay and Google Pay. Card details do not pass through our servers. You will receive a confirmation by email as soon as the payment is accepted.

05Creation and preview

Creation takes 10 to 15 working days from payment (5 to 7 working days with the Priority creation option), excluding delivery time. A photograph of the finished painting is emailed to the customer before shipping. The customer has seven days to approve it or request a revision; the first revision is included. Without a reply within this time, the painting is deemed approved and shipped.

The artist may reframe or simplify the background to serve the subject. If a photograph supplied does not allow a faithful rendering, Kapoland informs the customer before painting and offers another photograph or a refund.

06Delivery and collection

Home delivery: Italy (Italy): €9.90, free from €150, 3 to 6 working days ; Metropolitan France (Metropolitan France): €9.90, free from €150, 2 to 4 working days ; Europe (Belgium, Luxembourg, Germany, Spain, Netherlands, Austria, Portugal and Ireland): €24.90, free from €300, 4 to 8 working days. Large formats (from 50 × 70 cm) travel as bulky parcels, with a surcharge of €14 per order. Collection from the studio by appointment, free of charge.

The customer checks the condition of the parcel on receipt. Any damage must be reported by email within three days, with photographs: Kapoland takes the piece back and redoes or refunds it.

07Right of withdrawal

Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. Kapoland paintings can therefore be neither returned nor exchanged once creation has begun. The preview before shipping and the included revision serve as the guarantee of conformity with the approved rendering.

08Warranties

The legal warranties of conformity and against hidden defects apply. A painting that does not match the approved preview is taken back and redone.

09Intellectual property

The artist retains the copyright in the work. The customer acquires the physical copy and its private use. Kapoland does not publish the painting or the customer's photograph without their written consent.

10Disputes

These terms are governed by French law. In the event of a dispute, the customer may use a consumer mediator: details being appointed, provided on request. Failing agreement, the French courts have jurisdiction.
